Standard Conditions of Product/Equipment Hire

1 GENERAL - All hire goods remain the property of Exponet Pty Ltd at all times. Exponet Pty Ltd retains the right to alter, vary or substitute any item without notice. All goods are subject to stock availability.

2 PRICES - Unless otherwise indicated, all pricing is exclusive of GST, cartage and damage waiver. Prices are for the duration of the exhibition not exceeding 10 days. Prices for duration of general hire not exceeding 7 days.

3 PAYMENTS - Orders cannot be confirmed until all hire and other charges have been paid in full & processed.

4 LATE ORDERS- Furniture and Audiovisual orders placed during move in are to be charged an additional late order service fee. Electrical and shelving orders received after the specified due date displayed on the Exhibitor Show Kit will incur a 20% surcharge with a minimum $100.00 charge.

5 CARTAGE & PLACEMENT - All cartage and placement of equipment will be carried out by Exponet staff except as otherwise agreed in writing. Event cartage rates apply to CBD in Sydney/Melbourne/Brisbane. Other areas may attract additional cartage. For general hire cartage and placement POA.

6 PICK UP- All equipment must be available for pick up immediately after the event. No responsibility is taken for any goods left in or on our equipment after close of the event.

7 CANCELLATIONS -Any products delivered then cancelled will be charged at full rates.
Exhibitors with hire items (excluding custom, signage, sub-hire and production items)
Furniture, Audio Visual, Electrical and all other hire product cancelled within 28 days prior to the first Show installation date will be charged at 100% of the Exhibitor rate, excluding cartage/placement, installation fees and damage waiver.
Exhibitors with Custom Stands, Stand Packages, Signage & Production Items
Custom Stands, Stand Packages, Signage and Production items cancelled within 45 days prior to the first Show installation date will be charged: 100% of the total hire items ordered (inclusive of Furniture, Audio Visual and Electrical). Cancellation costs exclude cartage/placement, installation fees and damage waiver. 100% of the total production items ordered (inclusive of Signage, Custom Stands, Stand Packages and associated custom made items). Cancellation costs exclude cartage/placement, installation fees and damage waiver.

8 CLAIMS - Any problems with any Exponet equipment must be notified to Exponet on delivery. Exponet will not accept any responsibility after the conclusion of the Hirer’s event.


Hiring Agreement

These terms apply to all equipment hired by the Hirer from the Owner unless agreed to by the Owner and varied in writing.

1. Definitions
In these Terms, "Equipment" means the products, goods, stock or other items hired out by the Owner to the Hirer. "Hirer" means any person who requests the Owner to hire Equipment to it, including its employees and agents. A Hirer also includes event organisers and exhibitors. "Owner" means Exponet Pty Ltd ABN 45 132 935 105, its employees and agents. Terms means these terms and conditions. “PPSA” means the Personal Property Securities Act 2009 (Cth) (as amended). “PPSR” means the Personal Property Securities Register.

2. Terms of Payment
The Hirer agrees to pay the Owners hire charge and any other charges, including charges for loss, damage and repairs or any tax, GST, duty, levy, or other expenses paid or payable by the Owner. If not otherwise specified by the owner in writing all hiring charges including taxes and duties are to be paid prior to delivery of the equipment. The hirer agrees to provide the Owner with the Hirer's credit card number, expiry date and any other information, which may be necessary to debit the Hirers credit card prior to delivery of the equipment. Subsequent charges for loss, damage, repairs or other expenses are to be paid within seven days of the relevant invoice. The Hirer hereby authorises the Owner to debit the Hirers credit card with the amount shown on the relevant invoice if the Hirer has not paid that amount within seven days of the date of the relevant invoice. The Hirer agrees to pay any expenses incurred or loss suffered by the Owner as a result of breach of the Hirer of its obligation pursuant to these Terms (including legal costs on a solicitor-client basis) and to pay all costs and expenses incurred by the Owner, its legal advisers, mercantile agents and others in respect of anything instituted or being considered against the Hirer, whether for debt, possession of any Equipment or otherwise. The hirer acknowledges and agrees that the owner may pay a rebate, commission or other financial benefit to event organisers or like suppliers in connection with the hiring of the Equipment to the Hirer.

3. Credit Card Payment
A Surcharge applies to all payments

4. Termination of Hire
The Owner at its discretion may notwithstanding the specified period of hire and notwithstanding any waiver of any previous default by the hirer forthwith terminate this Agreement with or without notice to the Hirer and re-possess the equipment in any of the following events:
(a) If the Hirer shall fail to pay any hiring charges within two (2) days of the due date for such payment.
(b) If the Hirer shall do or permit any act or thing whereby the Owners rights in the equipment are or may be prejudiced.
(c) If the Hirer should become or be made insolvent or bankrupt or make any arrangement or composition with his creditors or in the case of a Hirer being a limited company, should any order be made or resolution passed for the winding up of such company or an Administrator, Receiver or Manager be appointed.
(d) If the Hirer commits any breach of this Agreement.
For the purposes of repossessing the equipment, the Owner may enter into or upon any premises where the equipment may be without prejudice to the rights of the Owner to recover from the Hirer any moneys due hereunder or any damages for breach thereof and so far as allowed by law the Hirer indemnifies the Owner in respect of any claims, damages or expenses arising out of any action taken under this clause. If after the hire period the equipment is not returned to the Owner in the manner pre-agreed between the Hirer and the Owner, then the Hirer shall pay an additional charge of 100% of the daily rate for each additional day or part thereof until the equipment is returned to the Owner. This is in addition to any other remedies the Owner may have against the Hirer pursuant to this hire agreement or at law.

5. The Hirers Obligations
The Hirer will:
(a) bear responsibility for the Equipment hired from the time of its delivery until collection by or return to the owner;
(b) upon installation, delivery or collection of the Equipment immediately examine the Equipment to satisfy itself as to its condition and suitability and fitness for the purpose to which it requires the Equipment. In accepting the Equipment the Hirer acknowledges that it has duly examined the Equipment and has satisfied itself as required. The Hirer acknowledges that it has not in any way relied upon the skill or judgement or any representation made by or on behalf of the Owner in respect of the Equipment, its purpose, suitability or performance. Should the Hirer alter its installation or delivery requirements prior to, during, or after installation or delivery, the Hirer is liable for all extra costs of the Owners employees and cartage;
(c) assume the risk of and indemnify and hold the Owner harmless from and against any and all property damage and personal injury resulting from:
(i) the use of the Equipment;
(ii) contact with underground cables, pipes, services or other obstructions;
(iii) all necessary surface repairs.
(d) use the Equipment in a proper, safe and prudent manner and only for the purpose and capacity for which is was designed.
(e) ensure all Equipment is returned or ready for collection by the Owners driver, in a clean, dry and properly packed condition and if being collected, is readily accessible. The Hirer will pay for all cleaning or drying costs and for any damage resulting from not properly drying, cleaning and/or packing the Equipment.
(f) obtain any required approvals or permits and pay any fees associated with the use of the equipment.

6. Loss of or Damage to Equipment
If the Equipment is lost, breaks down or is damaged, the Hirer must immediately notify the Owner of the details. Notification shall not absolve the Hirer from its obligations under these Terms. In the event that the Equipment breaks down or becomes unsafe to use, the Hirer shall immediately stop using the Equipment and take all necessary steps to prevent the Equipment from sustaining any further damage. The hirer must also take all steps necessary to prevent injuries from occurring to any person or property as a result of the condition of the Equipment and must not repair or attempt to repair the Equipment without the Owners prior written consent. If the Equipment is lost or damaged and the loss of or damage to the Equipment is caused by the negligence or act or omission of the Hirer or the breach of any of these Terms by the Hirer, the Hirer shall without limitation be liable for the following;
(a) any costs incurred by the Owner in repairing or replacing the Equipment;
(b) hire charges for the Equipment until the Equipment is replaced or repaired;
(c) any other costs whatsoever incurred or loss suffered by the Owner as a result of the damage to or loss of the Equipment.

7. Release and Indemnity and Limitation of liability
7.1 The Hirer hereby releases the Owner from, and agrees to indemnify the Owner in respect of any third party claims, action, suits, demands, costs and expenses for damage or injury to person or property arising directly or indirectly out of the hire or use of the Equipment by the Hirer or these Terms.
7.2 Except to the extent that the Owner is prevented by law, all guarantees, terms, conditions, warranties, undertakings, inducements or representations imposed by legislation in relation to the hire agreement whether express or implied, statutory or otherwise, relating to this hire agreement or its subject matter are excluded.
7.3 In circumstances where the Owner’s liability cannot be excluded and the Owner is able to limit the Owner’s liability the Owner’s liability is limited (at the Owner’s election) to the repair and replacement of the equipment or the supply of substitute equipment (or the cost of doing so).
7.4 Subject to clauses 7.2 and 7.3 the Owner’s maximum aggregate liability for any and all claims under or in connection with this hire agreement is limited to an amount equal to the fees paid by the Hirer under this hire agreement. The Owner will not be liable to the Hirer for any consequential, indirect or special loss or damage, loss of actual or anticipated profits or revenue, loss of business, business interruption, wasted costs the Hirer has incurred and amounts the Hirer is liable to third parties.

8. Damage Waiver
Damage Waiver is payable by the Hirer to cover the cost associated with the normal wear and tear to the equipment. It does not apply to any other damage to Equipment including:
(a) damage resulting from misuse, abuse, overloading, exceeding rated capacity, or improper servicing of Equipment
(b) damage due to the mysterious disappearance of the Equipment;
(c) damage caused by the use or operation of Equipment in contravention of any of the conditions of this agreement;
(d) damage to, or loss of, the Equipment from any unknown cause;
(e) failure to return the equipment;
(f) the hire equipment whilst in transit, if being carried by the Hirer, or an employee contractor or agent of the Hirer;
(g) damage or breakage of the equipment due to fire, storm or accident.

9. Insurance
The Hirer will maintain at its own expense all appropriate policies of insurance required by law and including:
(a) for theft and damage to the Equipment hired in an amount not less than the full replacement cost of the Equipment;
(b) for liability, property and casualty insurance coverage for an amount not less than $20,000,00.00 to indemnify the Owner and its Equipment against all claims, loss or damage whatsoever.

10. Special Conditions of Electrical Hire
Hirers should note that all electrical equipment used in an exhibition or event supplied by the owner or its subcontractors is operated solely by the owner. Further, such electrical equipment remains under the sole control of the owner. A hirer is permitted only to connect their own electrical equipment to any power points (GPO) supplied. Any other use or change to electrical equipment supplied and operated by the owner or its contractors may only be undertaken by the owner or its contractors or the approval of owner.

11. Price Lists
Any price lists published by the Owner may be changed without notice.

12. Availability
All goods are subject to stock availability

13. Force Majeure
Exponet will not be responsible for any delays in delivery or installation of equipment due to causes beyond Exponet reasonable control including but not limited to acts of God, war, terrorism, mobilization civil commotion, riots, embargoes, orders or regulations of governments of any relevant jurisdiction, fires, floods, strikes, lockouts or other labour difficulties. In an event of Force Majeure, then:
(a)The hiring agreement will not end, but Exponet and the Client will be released from further performance of its obligations under this Hiring Agreement/ proposal from the time when the event of Force Majeure happens;
(b) Exponet will be entitled to retain from any deposit or other monies paid be the client to Exponet the amount of any costs, charges or expenses actually incurred by Exponet before the event of Force Majeure happens, less any amount recovered by Exponet on account of successful insurance claims: and
(c) Exponet will not be liable to the client for any loss or damage, either direct or indirect, which may be suffered or incurred by the Client

14. PPSA
These terms create a security interest in favour of the Owner in the Equipment pursuant to the PPSA. The Hirer undertakes to immediately do such acts and provide such information as in the Owner’s opinion may be necessary or desirable to enable the Owner to perfect any security interest created or provided for by these Terms, as an enforceable, perfected and otherwise effective security interest with first priority. The Hirer agrees to the Owner registering it security interest on the PPSR. To the fullest extent permitted by law the Hirer waives any rights it may have now or in the future to receive a copy of any verification statement or other confirmation related to the interests created or provided for, or perfected in the manner contemplated by, these Terms.

15. Privacy
Information Collection and Use
Exponet will comply with the Australian Privacy Principles in all dealings with the Hirer or our website users. Exponet is the sole owner of the information collected on this site and agrees that it will not sell, share, or rent this information to others in ways different from what is disclosed in this statement.
Exponet may need to collect personal information about the Hirer, including but not limited to, full name and address, drivers licence details, credit card details, date of birth, and credit or business history. The Hirer consents to Exponet using personal information in order to:
(a) ascertain the Hirer or its guarantor’s credit worthiness;
(b) provide equipment and other services to the Hirer;
(c) prevent theft of the equipment;
(d) enter into contracts with the Hirer or third parties;
(e) market and maintain a relationship with the Hirer.

Consent to Disclose Personal Information
The Hirer consents to the Owner disclosing the Hirer’s personal information:
(a) to any credit provider or credit reporting agency for the purposes of obtaining information about the Hirer’s consumer or commercial credit or business history or the Hirer’s activities or credit worthiness; and
(b) to the Owner’s service providers, contractors and affiliated companies from time to time to help improve and market the Owner’s services to the Hirer.
The Hirer has the right to access the personal information the Owner holds about the Hirer.

Log Files
We use IP addresses to analyse trends, administer the site, track users movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.

Event Organiser

GENERAL
These Terms apply to all Organiser clients.
The client is responsible for all equipment provided by Exponet throughout the hire period and at all times during which it is onsite or in the client’s possession.

The client is responsible for monitoring the security of the site at the time of installation, dismantling and when the equipment is in use and not in use.

In the event of the equipment being stolen from the job site, the hirer shall notify the Company in writing stating the full circumstances of the theft and the time the police were notified. Until such notification is received by the company, the hiring charges will continue. The Hirer shall indemnify the Company for any such loss at the Company’s latest current price.

The client is to provide clear delivery, installation and pick up guidelines and instructions, including venue floor plan where necessary.

All quotes are based on information provided by the client. If the details change, Exponet reserves the right to review the pricing.

Quotes are given subject to venue approval, site inspection and availability of labour and equipment. Quotes may be amended or withdrawn based on these factors.

All proposals are quoted on a labour and stock availability basis and cannot be confirmed until the Exponet ‘Proposal Acceptance & Confirmation’ has been received and the deposit paid.

Your proposal is confidential and must not be shown to parties not directly related to this event without written agreement from Exponet.

The client may not infringe any copyright laws in relation to drawings, designs proposals or other material provided by Exponet. This material remains the property of Exponet at all times and cannot be reproduced without agreement.

Substitution of Equipment.
The Owner may substitute the Equipment with equipment of a similar type without liability to the Hirer.

Display of Name.
The Owner’s identification, trade name, trade mark and signage may appear on the Equipment. The Hirer must not conceal or obliterate these. The Hirer cannot claim any charges from the Owner for advertising in respect of these.

Risk
The Equipment is at the risk of the Hirer during the Hire Period and at all times during which it is on the Site or in the Hirer’s possession. The Hirer holds the Equipment as bailee and must take reasonable care of it. The Hirer must not part with possession of the Equipment or encumber it.

Instructions in Use
The Hirer acknowledges that it has received instructions in the use of the Equipment, that it understands those instructions, and will comply with them.

Inspection and Repair
The Owner may inspect and repair the Equipment at any time during the Hire Period. The Owner or its representative may enter upon the Site for this purpose.

Removal, Alteration and Use of Equipment
The Hirer must not: remove the Equipment from the Site or its position of installation; alter the Equipment; repair or attempt to repair the Equipment; or use the Equipment for a purpose which is different from that for which it is designed.


The client agrees that our standard Product/Equipment Hire Terms and Conditions apply other than as are inconsistent with any special terms agreed. Exponet’s complete Product/Equipment Hire Terms and Conditions are available for review on Exponet.com.au.

Regional Exhibitions
Any Exhibitions outside of the metropolitan areas in Sydney, Brisbane/Gold Coast or Melbourne will incur a regional freight and logistics charge. This fee will be based on the size and scope of the exhibition.

Artwork & Signage
All signage artwork must be received 21 days prior to installation or a 20% surcharge will apply. Onsite signage orders will receive a 33% surcharge.

Final approval of artwork is required 10 days prior to installation.

Exponet takes no responsibility for supplied material. Please ensure that all spelling and layout are correct as there is no compensation for errors.

Signage will be recycled after dismantle unless arrangements have been made prior to move out of the show.

While all due care will be taken, Exponet takes no responsibility for damage or wear and tear to signage caused during dismantle or transport.

Any fascia signs produced and not used if a booth changes size or where the booth is no longer required will incur a $60 charge per fascia sign. Any late fascia produced onsite will incur a $60 fee per fascia sign.

CAD Plans
Exponet requires a three to five working day turnaround for all floor plans (new and revisions).

The first eight floor plans are provided free of charge, additional revisions or new plans will be charged at $125 per hour +GST.

The final floor plan is to be confirmed no less than 5 working days prior to installation.

Competing Suppliers
If other suppliers with competing services to Exponet are appointed to components of your event, we reserve the right to review our pricing and any offers of sponsorship or FOC.

Damage Waiver
The damage waiver is a compulsory fee to cover the attrition of hire product.

A damage waiver will be charged on all structures, furniture, electrical and audio visual products however Organiser shell and carpet requirements are exempt.

Damage by fusion of electrical equipment is the Customer’s liability and failure to take out the necessary precautions will result in the Customer being charged for repairs to the damaged equipment.

Event Photography
As part of this signed agreement, Exponet may take photos at the event for use internally, or within external marketing channels as required. Usage submission will be sought for individual exhibitor stands.

SUPPLEMENTARY CHARGES
Event Cancellation
In the event of the Organiser cancelling the show within 90 to 30 days prior to the first installation date, Exponet reserves the right to charge the first deposit amount, or 50% of the total values of hire product allocated to the show, whichever is greater.
In the event of the Organiser cancelling the show within 30 days prior to the first installation date, Exponet reserves the right to charge the deposit amount or 75% of the total values of hire product allocated to the show (whichever is greater), as well as 100% of the total value for custom manufacture, production, signage items.
Exponet reserves the right to charge 100% of costs associated for all sub-hired or purchased product/services specific to the event.
Exponet also reserves the right to claim for any financial loss from exhibitor orders already confirmed as a result of the cancellation.

Minimum Charge
Exponet has a minimum exhibition management and installation service charge of $5000 +GST per event which includes all organiser services i.e. stands, registration, signage and furniture. Should your pre-payment estimate fall below this amount our Account Team can provide suggestions for additional services to meet the minimum fee.

Delivery, Access To The Site & Site Approval
Where it has been agreed between the Company and the Hirer that the equipment is to be delivered to an address specified by the Hirer the same shall be available to be picked up at the specified time arrange at that address on the last day of the hire period. Where the customer has taken delivery at the premises of the Company all equipment hired shall be returned to those premises by the time arranged on the last day of the hire period. In the event that equipment is not available to be picked up by the arranged time on the last day of hire or has not been returned to the premises of the Company by close of business on the last day of hire, then the Company must be notified.

The client is responsible for monitoring the security of the site at the time of installation, dismantling and when the equipment is in use and not in use.

The Hirer shall ensure that suitable access to and egress from the site is adequate to suit the mode of delivery or pick up.

The Hirer shall be responsible for giving any local or other authorities any necessary notice of their intention to erect equipment or to have equipment erected and shall pay all fees in connection therewith.

The Hirer shall solely be responsible to ensure that the site is cleared and ready for the erection of the equipment and that the foundation upon which the equipment is to be erected are sufficiently firm and otherwise suitable to safely carry the equipment and the load to be put on it without subsidence.

The Hirer / customer must ensure that there is provided lighting, water proofing, safe power supply, public protection, covering of power lines and such facilities as might be considered necessary for the requirements of Authorities or in the interest of safety.

Early/Late Access
Should the event be constructed outside standard working hours (prior to 0600 or after 2000) an early or late access fee may be charged.

This fee is calculated at a rate of $80 per person per hour plus GST.

The additional charge is only calculated on the hours worked outside standard working hours.

This will be determined once the final build schedule is decided and build plan approved.

Public Holidays
If the event / exhibition is built or dismantled on a public holiday, a surcharge will apply.

Split Load In & Out
If it is necessary to load the stock in for the build at two separate times (due to venue curfews), an additional charge will be applied. The charge consists of a minimum four hour call out per man, i.e. $80 per person per hour.

Force Majeure
Exponet will not be responsible for any delays in delivery or installation of equipment due to causes beyond Exponet reasonable control including but not limited to acts of God, war, terrorism, mobilization civil commotion, riots, embargoes, orders or regulations of governments of any relevant jurisdiction, fires, floods, strikes, lockouts or other labour difficulties. In an event of Force Majeure, then:
(a)The hiring agreement will not end, but Exponet and the Client will be released from further performance of its obligations under this Hiring Agreement/ proposal from the time when the event of Force Majeure happens;
(b) Exponet will be entitled to retain from any deposit or other monies paid be the client to Exponet the amount of any costs, charges or expenses actually incurred by Exponet before the event of Force Majeure happens, less any amount recovered by Exponet on account of successful insurance claims: and
(c) Exponet will not be liable to the client for any loss or damage, either direct or indirect, which may be suffered or incurred by the Client

Sponsorship/FOC
Any sponsorship or free of charge offer in a proposal is based on information provided by the client regarding the size of the event. Should this drop significantly, Exponet reserves the right to review our offer.
Sponsorship FOC does not apply to StyleMe, Structures, AV, Showcases, manufactured, subcontracted items, or digitally printed signage.

Sponsorship will be applied to the retail price of Features/Exponet products and services (prior to any discounts).

Additional requirements will be charged as per the agreed pricing within this agreement.

Exponet is promoted as the sole official exhibition builder and furniture supplier for your event.

Exponet is given access to any exhibitor marketing prior to the official release on the event website.

If other suppliers with competing services to Exponet are appointed to Exponet contracted events, we reserve the right to review our pricing for those events.

If the event spend on all exhibition stands, furniture and feature areas falls below stipulated amount in the proposal, we reserve the right to review the event sponsorship.

Event Sponsorship only applies to standard hire furniture used in non-exhibitor areas and is not available for resale to exhibitors.

Exhibitor Lists
Exponet reserves the right to review the Sponsorship and FOC if an accurate exhibitor list including stand name, stand number, contact email address and mailing addresses is not provided in Microsoft Excel format to Exponet prior to a list being published either electronically on the internet or in hard copy format and at least 8 weeks prior to the show opening.

Stock Availability
All stock is subject to availability on confirmation of project.

Exponet reserves the right to use sub-contractors where necessary.

Materials Handling
If, due to Venue Occupational Health and Safety regulations, a forklift spotter is required to guide fork lift drivers whilst operating in the exhibition hall, a forklift spotter fee will be charged. Forklift spotter fee: $150 per 1000sqm of exhibition space.

Some venues require specialist materials handling equipment for move in/out. Your Account Manager will advise if there are any additional charges for your venue.

CLIENT TERMS
GST
Prices listed in this agreement are exclusive of 10% GST.

Additional Costs
The Hirer must pay to the Owner in addition to the Price, all costs incurred by the Owner (including labour costs):
(a) Any flights and accommodation fees for Exponet staff, labour costs or late fees for fascia production are incorporated into costs.
(b) for delivery of the Equipment, including any additional costs for delivery to other than street level;
(c) for freight, installation, dismantling, packing and pick up of the Equipment;
(d) for providing any service to the Hirer outside of ordinary work hours, on weekends or public holidays;
(e) for design, consultancy and other similar services provided in connection with the hire of the Equipment or the Hirer’s event;
(f) if the Site is not adequately prepared for delivery and/or installation of the Equipment;
(g) if the Owner cannot obtain access to the Site;
(h) arising from a variation to the Contract, including without limitation: a change in the type of Equipment required; a change in the position where the Equipment is to be or has been installed upon the Site; a change in the location of the Site; or a change in the delivery or pick up instructions from those first agreed;
(i) arising from a failure of the Hirer to be in attendance at the agreed time for delivery or pick up of the Equipment;
(j) in cleaning the Equipment where it has been returned in an unclean state;
(k) for service calls to the Site during the Hire Period;
(l) for Site inspections in excess of 2 for any one Contract;
(m) in enforcing any provision of the Contract against the Hirer; and
(n) for replacement of any Equipment not returned by the Hirer at the end of the Hire Period, or at the Owner’s election 100% of the daily rate applicable under the Contract for each day or part thereof that Equipment remains unreturned. If any costs referred to in this clause are ascertainable before the Hire Period commences, they must be paid before that time. This provision does not limit the Owner’s rights to damages, compensation or indemnity under any other provision of these Terms.

Interest On Unpaid Amounts
The Hirer must pay interest to the Owner at the rate of 1% per month on any amount which is overdue, from the date it became due until the date it is paid.

Bond
If requested by the Owner the Hirer must pay (in addition to the Price) a bond equivalent to 10% of the Price. The Owner may apply so much of the bond as is necessary to compensate the Owner for any breach by the Hirer of the Contract, or any damage or loss sustained in respect of the Equipment. The balance if any is refundable to the Hirer.

Exclusion of Laws
To the extent permissable by law, all warranties or other rights implied by law in favour of the Hirer are excluded.

Termination
The Owner may terminate the Contract at any time without liability to the Hirer. If the Contract is terminated the Hirer must return the Equipment, or the Owner may at its election collect the Equipment from the Site at the Hirer’s cost.

Notification Of Costs
All pre-show quotes and post-show invoices will be itemised at time of submission.
Additional charges incurred onsite must be agreed to and approved for payment to be authorised.

Confidentiality
All documents relating to the contracted events are private and confidential.
Any information relating to the events, tenancy of the events or participants related to the events must not be shared with third parties without express written consent.

Prices
Prices are to remain fixed for the duration of the agreement.
Exponet reserves the right to requote or adjust pricing if event dates are changed.
A/V pricing is based on dates noted in the tender request documentation.

OUTDOOR EVENTS TERMS & CONDITIONS
The following terms and conditions for outdoor events apply in supplement and in addition to the terms and conditions for events and exhibitions held within a permanent venue, as outlined above. Prices included in quotations and proposals presented for outdoor events infrastructure including grand stand seating, structures and staging, include the following provisions:
• Labour (Available for during normal business hours: Monday to Friday 0600hrs to 1800hrs).
• Transport (Available during normal business hours: Monday to Friday 0600hrs to 1800hrs).
• Engineering certificate.
• Work Health and Safety site pack (Safe work method statement, risk assessment, crew training resister, crew competency sheet and prestart meeting with one revision).
• Online site inductions for crews or 1 hour onsite induction
• Full set of construction drawings with two revisions.
• Machinery for the move in and move out.

Prices included in quotations and proposals presented for outdoor events infrastructure including grand stand seating, structures and staging, do not include the following:
• Packing and/or Earth Works for un-level ground.
• Council Development Application and/or permits.
• Ground Protection for the move in and move out.
• Audio Visual, Signage, Power or Climate Control unless otherwise stated. These elements may be ordered through Exponet separately.
• Standby crew for the event days.
• Site fencing for work zone.
• Traffic management plan, traffic control or power line protectors.

Any proposals and quotations provided by Exponet’s Events Division are subject to:
• Final Move in and Move out schedule.
• Final Site inspection and structure position.
• Final Fire & Engineering requirements.
• Stock availability at the time of confirmation.
• Please note the quote valid for two weeks from quote date
• Payment terms are full payment of balance prior to event unless otherwise stated.

Custom Stand & Organiser Feature Areas

• The client is responsible for all equipment provided by Exponet throughout the hire period and at all times during which it is on site or in the client’s possession.

• The client is responsible for monitoring the security of the site at the time of installation, dismantling and when the equipment is in use and not in use.

• This quote is based on information provided by the client. If the details change, Exponet reserves the right to review the pricing.

• The client is responsible for obtaining approval of the stand design from the exhibition organiser.

• Quotes are given subject to venue approval, site inspection and availability of labour and equipment. Quotes may be amended or withdrawn based on these factors.

• All costs listed in this quotation are for the hire of componentry except where otherwise stated.

• All standard componentry is quoted on a labour and stock availability basis and cannot be confirmed until the ‘Acceptance & Confirmation’ has been received and the deposit paid.

• Custom built stands are temporary structures designed for 2 to 3 uses, after this the stand may begin to deteriorate due to general wear and tear. Any usage beyond this will incur a fee for maintenance and repairs, or the building of a new stand.

• This document is confidential and must not be shown to parties not directly related to this event without written agreement from Exponet.

• The client may not infringe any copyright laws in relation to drawings, designs proposals or other material provided by Exponet. This material remains the property of Exponet at all times and cannot be reproduced without agreement.

• The client agrees that our standard terms apply other than as are inconsistent with any special terms agreed. Exponet complete terms and conditions are available for review on www.Exponet.com.au

Artwork & Signage

• All signage artwork must be received 21 days prior to installation or a 20% surcharge will apply. Onsite signage orders will receive a 33% surcharge. Final approval of artwork is required 10 days prior to installation.

• Exponet takes no responsibility for supplied material. Please ensure that all spelling and layout are correct as there is no compensation for errors.

• Signage will be recycled after dismantle unless arrangements have been made prior to move out of the show.

• While all due care will be taken, Exponet takes no responsibility for damage or wear and tear to signage and custom structures caused during dismantle or transport.

CAD Plans

• Exponet requires a three to five working day turnaround for all CAD plans (new and revisions)

• The first four CAD plans are provided free of charge, additional revisions or new plans will be charged at $125 per hour + GST

• The final design is to be confirmed no less than10 working days prior to installation.

Damage Waiver

• The damage waiver is a compulsory fee to cover the attrition of hire product.

• Damage waiver applies to all hire equipment including structures, furniture, shelving, electrical and audio visual products.

• Damage by fusion of electrical equipment is the Customer’s liability and failure to take out the necessary precautions will result in the Customer being charged for repairs to the damaged equipment.

On Site Variations & Additions

• Exponet reserves the right to charge for any changes requested on site to the signed off plans.

• Late fees apply to onsite orders

Design vs Quotation

• If, as a result of budget or other constraints, there is a variation between the design drawing and this quotation, the stand will be produced as per the quotation.

Stand Cancellation

• Custom Stands, Stand Packages, Signage and Production items cancelled within 45 days prior to the first Show installation date will be charged: 100% of the total hire items ordered (inclusive of Furniture, Audio Visual and Electrical). Cancellation costs exclude cartage/placement, installation fees and damage waiver.
